A title-deed timeshare is a right, recorded in the land register, that lets each co-owner of a residential building use it during set periods of the year. Under Turkish law it is a registered timeshare right, and Articles 57–65 of Turkish Condominium Law No. 634 regulate it.
What the law says (Condominium Law No. 634, Art. 57–65)
- Definition (Art. 57): The right is created as an easement attached to a co-ownership share and gives use of the building during set periods of the year.
- Where it can be created (Art. 58): Only in residential buildings under condominium ownership or a condominium easement, or in detached buildings. Unless the deed states otherwise, shares are equal, based on the number and length of the periods.
- Transfer and inheritance (Art. 58): The right can be transferred with its share and passes to heirs.
- Minimum period (Art. 59): Periods are set within the year and cannot be shorter than 7 days (reduced from 15 days in 2022). Unless the contract says otherwise, the owner may let others use the period.
- Registration (Art. 60–61): The right is noted in the declarations section of the land register and on the title deed. The timeshare contract, covering period length, use, the manager, the major-repair period and maintenance costs, is attached to the official deed.
- Management (Art. 61): The co-owners appoint a manager.
- No partition (Art. 63): Unless the contract says otherwise, co-owners cannot demand partition of the co-owned property.
- End of period (Art. 64): Owners must vacate at the end of their period and hand over to the next owner.
- Other matters (Art. 65): The Turkish Civil Code applies where the law, the contract or the management plan is silent.
Your rights as a consumer (Law No. 6502 Art. 50 and the Timeshare Regulation)
Contracts that grant a title-deed timeshare right also fall under the timeshare provisions of the Consumer Protection Law:
- Pre-contract information: A written pre-contract information form must be given at least one day before the contract (Law Art. 50/4; Regulation Art. 5).
- Form of contract: Except in distance sales, the consumer writes the contract date by hand and signs, and receives a copy (Art. 50/5; Regulation Art. 6).
- 14-day withdrawal: The consumer may withdraw within 14 days without giving a reason or paying a penalty (Art. 50/6; Regulation Art. 7). For title-deed timeshare contracts, notice is sent through a notary (Regulation Art. 8/1).
- No payment during the withdrawal period: No payment or debt instrument may be requested before the withdrawal period ends, and any amount taken must be refunded at once (Art. 50/6; Regulation Art. 9/1). After withdrawal, refunds are due within 14 days of the seller receiving the notice (Regulation Art. 9/3).
- Who may sell: Only holders of a real right in the property may sell. Timeshare rights may not be granted through membership of a cooperative, company, association or foundation (Art. 50/2).
- Prepaid contracts banned: Prepaid timeshare contracts, including those granting a title-deed timeshare right, may not be made with consumers (Art. 50/8; Regulation Art. 4/A).
